Terms & Conditions

These Terms and Conditions govern purchases made through nimfea.co.uk. NIMFEA is the trading name used by Felicia Bottomley, an individual trader in the United Kingdom. These terms do not represent NIMFEA as a limited company.

1. Seller and contact

A business/service address must be added to these Terms before publication where required by applicable law.

2. Products

NIMFEA sells plant-based skincare and related personal-care products. Product descriptions, ingredients, images, sizes and other information are provided on the relevant product page. Minor variations in colour, appearance or packaging may occur.

Customers should read the ingredient list and product-specific instructions before use and should discontinue use if irritation or an adverse reaction occurs. Product information does not replace individual medical or dermatological advice.

3. Orders and contract

You may purchase products by creating an account or checking out as a guest. You are responsible for providing accurate delivery and contact information.

After you place an order, we will send an order confirmation to the email address provided. The order confirmation acknowledges receipt of the order; the contract is formed when we accept the order, normally when we confirm that the goods have been dispatched, unless we notify you otherwise.

We may decline or cancel an order where a product is unavailable, there is an obvious pricing or description error, payment cannot be authorised, or we reasonably suspect fraud or misuse. If we cancel an order after payment, we will refund the amount paid.

4. Prices and payment

Prices and applicable delivery charges are displayed at checkout. Payment is processed through Stripe and must be completed using an available payment method before an order is dispatched, unless otherwise stated.

If taxes, customs duties or import charges are payable in the destination country, these may be the customer's responsibility unless the checkout expressly states otherwise.

5. Delivery

Orders are generally dispatched within 2–3 working days, subject to product availability and circumstances outside our reasonable control. Delivery times shown on the website are estimates unless expressly stated as guaranteed.

We deliver to the UK, EU and other international destinations where available. The customer is responsible for providing a complete and accurate delivery address.

If goods do not arrive within the applicable delivery period, please contact sales@nimfea.co.uk so that we can investigate.

6. International orders

International customers are responsible for complying with applicable import laws in their destination country and for paying customs duties, import VAT or other charges imposed by the destination country unless the checkout expressly states otherwise. NIMFEA cannot guarantee that every product is permitted for import into every jurisdiction.

7. Right to cancel

If you are a UK consumer buying online, you generally have a statutory right to cancel a distance contract without giving a reason. The cancellation period normally ends 14 days after the day you receive the goods. If an order contains multiple goods delivered separately, the period normally runs from receipt of the last item.

To cancel, email sales@nimfea.co.uk with a clear statement that you wish to cancel. You may use the model cancellation wording below, but it is not mandatory to do so.

After notifying us, you must return the goods without undue delay and normally within 14 days. Unless the goods are faulty, misdescribed, or another legal exception applies, you are responsible for the direct cost of returning goods.

8. Sealed skincare and hygiene products

The statutory cancellation right may not apply to goods that are sealed for health protection or hygiene reasons where the seal has been broken after delivery. This does not affect your statutory rights where goods are faulty, unsafe, misdescribed or otherwise do not conform to the contract.

9. Refunds

Where you validly cancel a distance contract, we will refund payments due under applicable law. This normally includes the cost of standard delivery, but not an additional amount paid for a more expensive delivery option.

We may withhold reimbursement until we have received the returned goods or you have supplied evidence that they have been sent back, whichever occurs first where permitted by law.

Where the value of goods has been reduced because you handled them beyond what was reasonably necessary to establish their nature, characteristics and functioning, we may make a lawful deduction for that diminished value.

10. Faulty, damaged or incorrect goods

Nothing in these Terms limits your statutory rights. Goods supplied to UK consumers must meet the requirements of applicable consumer law, including being of satisfactory quality, fit for purpose and as described.

If goods arrive damaged, defective or incorrect, contact sales@nimfea.co.uk as soon as reasonably practicable with your order number and details. We will provide an appropriate remedy in accordance with applicable law.

11. Product safety

Use products only as directed and review the ingredients and product warnings before use. Customers with known allergies or sensitivities should assess the ingredients carefully and seek professional advice where appropriate. Nothing in these Terms excludes liability that cannot legally be excluded.

12. Account

You may create a customer account or purchase as a guest. You are responsible for keeping account credentials confidential and for activity carried out through your account. We may suspend an account where reasonably necessary for security, fraud prevention or misuse.

13. Intellectual property

Unless otherwise stated, website content including text, photographs, graphics, logos, product descriptions and branding is owned by or licensed to NIMFEA and may not be reproduced or commercially exploited without permission, except where permitted by law.

14. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights. Subject to those limitations, NIMFEA is not responsible for losses that are not reasonably foreseeable or arise outside the scope of the contract.

15. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, natural disasters, war, industrial action, carrier disruption, government action, major infrastructure failure or significant website/payment-service outages. This does not remove statutory consumer rights.

16. Complaints

Please contact sales@nimfea.co.uk first so we can investigate and attempt to resolve any complaint.

17. Governing law

These Terms are governed by the law of England and Wales, unless mandatory consumer-protection rules in your country of residence provide otherwise. UK consumers may also have rights to bring proceedings in the courts of the jurisdiction where they live.

19. Changes to these Terms

We may update these Terms from time to time. The version applying to an order is the version made available before that order was placed, unless a change is required by law.

Privacy Policy

This Privacy Policy explains how NIMFEA, operated by Felicia Bottomley, processes personal data when you visit or purchase from nimfea.co.uk. NIMFEA is currently operated by Felicia Bottomley as an individual trader and is not represented in this document as a limited company.

1. Data controller

The data controller is Felicia Bottomley, trading as NIMFEA.

NIMFEA does not currently publish a separate business telephone number. A physical business address has not yet been provided; this Privacy Policy should be updated with the trader's business/service address before publication where required.

2. Personal data we collect

  • Identity and contact information, such as your name, email address, billing address, shipping address and other contact details you provide.
  • Order and transaction information, including products purchased, order value, delivery information and order history.
  • Account information if you create an account, including login credentials and account preferences. Passwords are handled using the website's authentication system and should not be stored by NIMFEA in plain text.
  • Communications you send to NIMFEA, including customer-service enquiries, complaints and requests.
  • Technical information necessary to operate and secure the website, such as IP address, browser/device information, session information and security logs, where collected by the website's hosting, ecommerce or security infrastructure.
  • Cookie information as described in the Cookie Policy.

3. How we use personal data

  • To process and fulfil orders, including payment, packing, shipping, delivery and returns.
  • To create and administer customer accounts where you choose to create one.
  • To communicate with you about orders, deliveries, returns, refunds, complaints and other service matters.
  • To prevent fraud, abuse and security incidents and to protect the website and our customers.
  • To maintain business records and comply with legal, accounting and tax obligations.
  • To improve and maintain the website and its functionality.
  • To send marketing communications only where we have a lawful basis to do so and, where required, your consent.

4. Lawful bases

Depending on the circumstances, NIMFEA relies on the following UK GDPR lawful bases: performance of a contract, compliance with a legal obligation, legitimate interests, and consent. Legitimate interests may include operating and securing the shop, responding to enquiries, preventing fraud, maintaining business records and improving services where those interests are not overridden by your rights.

5. Payments

Online card and other supported payments are processed by Stripe. NIMFEA does not intend to receive or store your complete payment-card number or security code on its own systems. Stripe may process personal and payment information under its own privacy terms and security procedures. Payment information is shared with Stripe to process your transaction and prevent fraud.

6. Service providers and sharing

We may share relevant personal data with service providers needed to operate the shop, including payment processors such as Stripe, website/ecommerce hosting providers, email providers, delivery and postal carriers, IT/security providers, professional advisers, and authorities where disclosure is required by law.

We do not sell customer personal data.

7. International transfers

Some service providers may process personal data outside the United Kingdom. Where UK data-protection law requires safeguards for an international transfer, NIMFEA will use an appropriate lawful transfer mechanism and applicable safeguards.

8. Data retention

We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, including fulfilling orders, handling returns and complaints, maintaining accounting and tax records, resolving disputes and meeting legal obligations. Different categories may therefore be retained for different periods.

9. Your rights

Subject to legal conditions and exemptions, you may have rights to access your personal data, correct inaccurate data, request erasure, restrict processing, object to certain processing, request data portability, and withdraw consent where processing relies on consent. You also have the right to complain to the UK's Information Commissioner's Office (ICO).

Requests should be sent to sales@nimfea.co.uk. We may need to verify your identity before completing a request.

10. Children

The shop is intended for general consumers and is not directed specifically at children. We do not knowingly seek to collect personal data from children for marketing purposes.

11. Cookies

NIMFEA currently does not use Google Analytics, Meta Pixel or other analytics platforms. The website may nevertheless use strictly necessary cookies and cookies placed by ecommerce, security, payment or other website functionality. See the separate Cookie Policy for further information.

12. Automated decision-making

NIMFEA does not currently carry out solely automated decision-making that produces legal or similarly significant effects on customers.

13. Changes

This Privacy Policy may be updated from time to time. The latest version will be published on the website with its effective/update date.

This Cookie Policy explains how NIMFEA uses cookies and similar technologies on nimfea.co.uk.

1. What are cookies?

Cookies are small text files stored on a device when a website is visited. They can be used to make a website function, remember preferences, support security and provide information about website use.

2. Current use of cookies

NIMFEA does not currently use Google Analytics, Meta Pixel, Google Ads tracking, TikTok Pixel or other analytics/advertising tracking systems.

The website may use strictly necessary cookies or similar technologies required for functions such as maintaining a shopping basket, customer login/session state, checkout, security, fraud prevention, remembering necessary preferences and enabling payment or ecommerce functionality.

3. Third-party services

Stripe may use cookies or similar technologies in connection with payment processing, fraud prevention and security. The exact technologies used may depend on the payment flow and Stripe's current implementation.

Other website infrastructure providers may also place strictly necessary cookies where required to deliver the service. The specific cookies in use can change when website functionality or providers change.

4. Analytics and advertising

NIMFEA does not currently use analytics or advertising cookies for behavioural tracking. If this changes, this policy will be updated and, where required, appropriate consent mechanisms will be implemented before non-essential cookies are placed.

5. Managing cookies

You can control or delete cookies through your browser settings. Blocking strictly necessary cookies may prevent parts of the website, including account, basket or checkout functionality, from working correctly.

This Cookie Policy may be updated when website technologies or legal requirements change. The latest version will be published on the website.
